Who is a process server?
A process server is, simply put, someone who serves legal documents on behalf of a court or individual, making sure that the recipient is aware of and confirms the reception of said documents. Process servers play a vital role in the legal process, expediting the speed of courts of law, and oftentimes allowing for more civil, discreet, and safe reception of documents on behalf of individuals who might not take it in a fantastic sort of way.
How does serving documents work?
We normally need two copies of the document(s) being served: a copy to serve, and a copy to attach to an Affidavit (which will be returned to you). If you only have one copy to send, simply photocopy it. If there are multiple witnesses or defendants, we will need copies for each person to be served on.
How long does it usually take to serve someone?
It depends on the situation of the person we are serving. We will make attempt usually within 24 hours and at a time that we reasonably believe the person will be there, and based on the information you give us. It is rare that a document does not get served, unless the individual has moved etc. Service is usually effected within 3 attempts. Rush service is available.
What areas of Vancouver Island do you cover?
We serve court documents everywhere between and including Bowser and Sayward, including Courtenay, Comox, Cumberland, Deep Bay, Union Bay, Royston, Merville, Black Creek, Campbell River, Gold River, and the Islands of Denman, Hornby, Cortes and Quadra.. We have associations with Process Servers anywhere on Vancouver Island.
My documents are private. Can you maintain that confidentiality?
Our firm is committed to maintaining confidentiality in all matters. We will not discuss or share your information with anyone or any other organization. We maintain a strict policy of privacy.
How do I get the documents to you?
If local, (within The Comox Valley or Campbell River), we can pick them up at your location. If you are sending them from out of town, you may courier them to us or send by regular mail or email depending on the urgency.
Will you send me the affidavit?
Once the document(s) are served, we will create an Affidavit of Personal Service (a sworn statement telling the court: who, what, when, where and how the party was served) and get it sworn. sworn by a Commissioner of Oaths. The affidavit will be attached to the documents sent back to you. You will need to file the Affidavit of Service with the court. We can file it for a fee if you wish. Let us know.
How do I pay?
We will invoice lawyers, law firms and government agencies. For all others, we require payment in advance of any attempts at service. We accept cash, cheque, Interac (email money transfer), money orders, certified cheques, bank drafts, solicitor’s trust cheques.
What information do I need to supply?
Aside from the documents you want served, the more information about the person or company to be served, the better. Addresses of home and work, a photo of the person, type of car they drive, do you know their general whereabouts or where they would likely be located and when.
